Description
Brent Eli Morris, a Nevada state prisoner, appeals pro se the district courts partial dismissal of his 42 U.S.C. § 1983 action. In his complaint, Morris challenged the ten-day delay in the shipment of his legal documents when he was transferred from a state prison to a county detention center for court appearances. He also claimed that some of the documents were lost. The district court granted the motions to dismiss filed by two state attorneys general and the state prison warden on the ground that Morris failed to oppose the motions, and thereby consented to the granting of the motions under Local Rule 140-6 of Rules of Practice for the United States District Court for the District of Nevada ("Local Rule 140-6"). We review the district courts dismissal of these defendants under the local rules for an abuse of discretion, Carey v. King, 856 F.2d 1439, 1440 (9th Cir. 1988), and we affirm.
